This Terms of Service (“Terms”) is a binding agreement between you (the “End-User”) and Fyzam (“Licensor,” “we,” “us,” or “our”), the developer of the Vinto mobile application (the “App”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
These Terms are concluded between you and Fyzam only. Fyzam is solely responsible for the App and its content. The app store or platform from which you obtained the App is not a party to these Terms.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, solely for personal, non-commercial use, subject to these Terms and the Google Play Terms of Service (or other platform terms) where applicable.
Fyzam is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. The platform from which you obtained the App has no obligation to furnish maintenance or support for the App, except as that platform’s own terms may separately require.
Fyzam is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Refunds for paid downloads or in-app purchases, if any, are handled by the applicable app store according to that store’s policies. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Fyzam’s sole responsibility (subject to applicable law).
You and Fyzam acknowledge that Fyzam is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. These Terms do not limit Fyzam’s liability to you beyond what is permitted by applicable law.
In the event of any third-party claim that the App or your possession and use of it infringes that third party’s intellectual property rights, Fyzam will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
The App, including its software, design, text, graphics, and trademarks (including “Vinto”), is owned by Fyzam or its licensors and is protected by intellectual property laws. Except for the limited license above, no rights are granted to you.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

You must comply with applicable third-party terms of agreement when using the App. For example, you must not violate your wireless data service agreement, and you must comply with the Google Play Terms of Service and the terms of any third-party services used by the App (including Firebase, sign-in providers, advertising, and analytics), as applicable.
Vinto provides daily micro-missions, gamification, optional community features (such as display names on a weekly board and friends), and optional premium subscriptions. Features may change over time.
There is zero tolerance for objectionable content or abusive users.
Community features may show your display name, avatar, and limited activity stats to other users. You must not post or share content that is harassing, hateful, sexually explicit, violent, spammy, illegal, or otherwise objectionable. You must not abuse, threaten, or impersonate others.
We may filter, remove, or restrict content that violates these Terms, including display names and profile information. We may eject (suspend or permanently ban) users who provide offending content or engage in abusive behavior.
If you see objectionable content or an abusive user, use Report and/or Block in the Community section of the App. Blocking removes that user’s content from your Community views immediately. Reports notify us so we can review them.
We aim to review objectionable-content reports within 24 hours and, when appropriate, remove the content and restrict or eject the responsible account.
Premium plans and other in-app purchases are billed through Google Play (or the applicable store) and are subject to that store’s terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel in your store account settings. Refunds, if any, are handled by the store according to its policies.

This license is effective until terminated by you or Fyzam. Your rights under this license will terminate automatically without notice if you fail to comply with these Terms. Upon termination, you must cease all use of the App and delete all copies.
We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the App after changes become effective constitutes acceptance of the revised Terms where permitted by law.
